ELIGIBILITY: Sweepstakes is open to legal residents of the 50 United States and D.C., 21 years of age or older, except employees and the families of Dreyer’s Grand Ice Cream, Inc. d/b/a Nestlé Dreyer’s Ice Cream Company ("Sponsor") and its respective shareholders, parents, directors, officers, affiliates, representatives, agents, successors, prize suppliers, and each of their affiliates, subsidiaries and agencies. Sponsor and its affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by the prize winners against, any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession or loss of any prize, or his/her participation in this Sweepstakes. PROMOTION PERIOD: Sweepstakes begins at 12:01 a.m. (Pacific Time) PT on 3/1/2011 and ends at 11:59 p.m. PT on 6/30/2011 ("Promotion Period"). Sponsor’s computer is the official timekeeping device for the Sweepstakes.
HOW TO ENTER:
To Enter Via On-Pack Code: Specially-marked Skinny Cow™ low fat ice cream cup products will have a code located under the lid. Once you have obtained the code, log on to www.skinnycow.com/perfectcup during the Promotion Period and follow the on-screen instructions to complete registration. After you submit your first name, last name, email address and Code ("registration"), some type of animation will appear informing you if you are a potential winner ("a Play"). You must indicate that you are 21 years of age or older and agree to the Official Rules as a pre-condition to execution of a Play.
To receive a Code without making a purchase: log on to www.skinnycow.com/perfectcup during the Promotion Period and follow the on-screen instructions to request a free Code. After you submit your first name, last name and email address, you will receive a free Code which will automatically be entered in the appropriate field on the "Enter Your Code" page. After completion of whatever additional registration is required, some type of animation will appear informing you if you are a potential winner ("a Play"). You must indicate that you are 21 years of age or older and agree to the Official Rules as a pre-condition to execution of a Play.
For All Entry Methods: Limit of three (3) entries/plays per person or e-mail address per day. Each code will generate one (1) entry/Play per email address per day. Multiple participants may not share the same email address. Any attempt by any participant to obtain more than the stated number of entries/plays by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant’s entries/plays and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to the identity or eligibility of a potential Winner, the winning entry/play will be declared by the authorized account holder of the e-mail address used to enter the Sweepstakes. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address.
Codes have no cash value and cannot be redeemed or exchanged for cash/credit. Codes cannot be exchanged, sold/purchased or bartered; and, any attempt to do so renders Code void. Codes expire 6/30/2011 at 11:59 p.m. PT when Sweepstakes ends and after such time are void. Any attempted use/use of Codes in violation of these Official Rules is void. In addition to disqualification and prize forfeiture, such conduct constitutes fraud (and Sponsor reserves the right to take any and all necessary and appropriate actions so as to protect such rights).
WINNER SELECTION: During the Promotion Period, "winning" dates/times will be randomly pre-selected by an independent digital agency with one Prize being randomly assigned to that date/time. The first registered participant who receives a successfully executed Play (as received and recorded by Sponsor’s computer) on or after the selected "winning time" is the potential winner of the Prize assigned to that date/time. All Prize notifications are subject to verification and compliance by the winner with these Official Rules. You are not a Prize winner unless and until you have been personally informed by Sponsor or its agency to such effect. Screen shots will NOT be accepted as proof of winning Prize. If you are a potential winner, a "winning" message will be shown indicating that you’ve won the identified prize and you will win that prize, subject to verification and completion of Prize Claim Form ("successful execution of a Play"). After providing additional prize information (if required) (e.g., for Second Prize, bra size, wire preference, color choice), click on the "Claim Your Prize" button which will take you to the Prize Claim Form. On the Prize Claim Form, confirm the accuracy of your first and last name and email address as they appear on the Form and provide your complete mailing address (including city, state and zip code – no P.O. Boxes); this is needed to send you the appropriate documents to be completed (if a potential Grand Prize or First Prize winner) or to ship the prize (for potential Second Prize and Third Prize winners). See Prizes Section below for prize details. If you are NOT a Prize winner, the following message will appear "Sorry, Try Again" but you will automatically be entered once per play into the Second Chance Drawing. You will also be entered into the Second Chance Drawing if you won either a Second Prize or a Third Prize; but, if you already won a Grand Prize or First Prize, you will NOT be entered into the Second Chance Drawing. See Second Chance Drawing Section below for additional details.
SECOND CHANCE DRAWING: All registered participants who were not selected as a potential Prize winner will automatically be entered into a Second Chance Drawing for any remaining Grand Prizes and First Prizes. The Second Chance drawing will be used to award any Grand or First Prizes that cannot be distributed through the Sweepstakes, regardless of reason (by way of example, if a potential winner cannot be verified in accordance with these Official Rules, is not eligible to win a prize, is disqualified for any reason, etc.). ENTRY INTO THE SECOND CHANCE DRAWING DOES NOT GUARANTEE THAT ANY DRAWING WILL OCCUR OR THAT ANY PRIZE WILL BE AWARDED VIA THE DRAWING. IF ALL PRIZES CAN BE DISTRIBUTED THROUGH THE SWEEPSTAKES AND IN FULL COMPLIANCE WITH THESE OFFICIAL RULES, THEN NO SECOND CHANCE DRAWING WILL OCCUR. However, if a Second Chance drawing is needed for any reason, the Second Chance random drawing will be held on or about 7/12/2011, from all eligible entries received. Odds of winning depend upon the number of eligible entries received and the number of unclaimed Grand Prizes (if any) and First Prizes (if any). Potential Prize winner(s) selected via the Second Chance random drawing (if any) will be notified via email and must respond within 24 hours with their mailing address information (including city, state and zip code – no P.O. Boxes). If the potential winner does not respond within the required time period, that potential prize winner’s entry will be disqualified and an alternate potential prize winner will be selected in accordance with the terms of this paragraph.
PRIZES:
Five (5) GRAND PRIZES Winners will receive a trip from Friday, August 26, 2011 – Sunday, August 28, 2011 to attend the Perfect Cup Event on Saturday, August 27, 2011 ("Perfect Cup Event Package") for Winner and one (1) guest. Package includes: (i) round-trip coach air transportation for Winner and one (1) guest from a major airport near the Winner’s residence (as determined by Sponsor) to Los Angeles, CA (if a Grand Prize Winner resides within 250 miles of Los Angeles, CA, ground transportation will be provided in lieu of air travel and no cash difference will be awarded); (ii) two nights hotel accommodations (one standard room, double occupancy; hotel to be selected by Sponsor); (iii) ground transportation to/from Los Angeles airport and hotel and to/from hotel and Perfect Cup Event; (iv) $500 awarded as a check. Approximate Retail Value ("ARV") of each Grand Prize: $5,300. Actual value may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Promotion, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. Guest of winner must be 21 years of age or older. Winner and guest must travel on the same itinerary; travel must take place on the dates specified by Sponsor. Travel companion must execute liability/publicity releases prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply. If Winner is unable to travel for any reason on dates specified by Sponsor, the prize will be forfeited in its entirety and, an alternate Winner will be selected via the Second Chance Drawing (as discussed above). Expenses not specifically stated in these Official Rules, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses, are the sole responsibility of the winner. Any picture identification requirements associated with travel are the Winner and guest's responsibility. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Sponsor and its agencies are not responsible for flight delays or inability of Winner or guest to take Perfect Cup Event Package or related benefits in accordance with applicable rules and restrictions, and/or any other difficulties occurring during or in connection with Perfect Cup Event Package or related activities. Attendance at Perfect Cup Event has no cash value and if Perfect Cup Event is cancelled for any reason, Sponsor’s liability will be limited to awarding the remaining aspects of the Grand Prize (i.e., a trip to Los Angeles, as set forth above).
FIRST PRIZES (10): Ten (10) First Prize Winners will each receive a bra collection of five (5) bras. (ARV $170 each). Winners will be contacted by a specialist from the supplier of the First Prize who will assist with prize fulfillment (including size, style and color preferences).
SECOND PRIZES (2,500): Two thousand five hundred (2,500) Second Prize Winners will each receive a bra (ARV $34 each).
THIRD PRIZES (5,000): Five thousand Prize Winners will each receive a coupon for a free Skinny Cow™ low fat ice cream cup. Coupon subject to terms and conditions of use. (ARV $1.99 each). IF COUPON IS PROHIBITED BY LAW, PRIZE WILL BE DELIVERED IN THE FORM OF A $1.99 CHECK.
Approximate Odds of Winning: Grand Prize - 1:2,108,160; First Prize – 1:1,054,080; Second Prize – 1:4,216; Third Prize – 1:2,108. Actual odds of winning depend on the number of registered participants and the number of Plays received during the Promotion Period and when during the Promotion Period a registered participant plays the Sweepstakes.
TOTAL ARV OF ALL PRIZES: up to $123,150.
GENERAL PRIZE CONDITIONS:
No cash substitutions for prizes/prize components will be permitted and prizes are nonrefundable and nontransferable, except at sole discretion of Sponsor. Sponsor reserves the right to substitute prize for one of equal or greater value. Federal, state and local taxes are the sole responsibility of the Winner. Limit: One (1) Grand Prize or First Prize per person/family/household/email address.
Grand Prize and First Prize Winners will be required to sign and have notarized a Winner’s Agreement and Release and return it by date specified or prize will be forfeited in its entirety. In the event of forfeiture of Grand Prize or First Prize, another winner will be selected via the Second Chance Drawing. Return of any prize or prize notification as undeliverable will result in prize forfeiture. In the event of prize forfeiture for Grand Prize or First Prize, an alternate Winner will be selected via the Second Chance Drawing. IF FORFEITED, SECOND PRIZES AND THIRD PRIZES WILL NOT BE AWARDED. Please allow 6–8 weeks for delivery of First Prizes upon confirmation of eligibility and 6-8 weeks for delivery of Second Prizes and Third Prizes upon winner notification. By entering the Sweepstakes, entrants accept and agree to these rules and the decisions of the Sponsor, which shall be final.
Except where prohibited, participation in the Sweepstakes constitutes winner’s consent to Sponsor’s use of winner’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) and country of residence for promotional purposes in any media, worldwide, for an unlimited period of time without further payment or consideration for the purpose of promoting this Sweepstakes (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Sponsor.
OTHER CONDITIONS: Sponsor and its agencies are not responsible for incomplete information, incomplete transmission defaults or faulty network connections, telephone, computer server/system/software failure of any kind, and/or delayed garbled or corrupted data. Any attempts by an individual to access the Sweepstakes or Web site via a bot script or other brute-force attack will result in that IP address becoming ineligible. Sponsor reserves the right to suspend/terminate (in whole or part) this Sweepstakes without notice if, in Sponsor’s sole discretion, the Sweepstakes becomes infected, corrupted or the administration, security, fairness, integrity or proper play of the Sweepstakes is compromised. In such event, to the extent possible, Sponsor will make all prizes available to be won pursuant to these Official Rules. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or Web site, to be acting in violation of the Official Rules or any laws, or to be attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, misappropriation, infringement or any other unfair playing practices/poor sportsmanship, or intending to annoy, abuse, threaten or harass any other entrants/players or Sponsor representatives. Sponsor is not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software (beyond Sponsor’s reasonable control); (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize (other than as a direct result of the Sponsor's or its representatives’ or vicarious agents’ negligence). All Codes/entries are subject to verification. Codes are void and will be rejected if they contain printing, typographical, programming, mechanical or other errors or are otherwise printed/produced in error. Codes are also void (and will be rejected) if not obtained through authorized, legitimate channels, or if any part is defective, illegible, altered, duplicated, photocopied, reproduced, forged, counterfeited, defaced, mutilated or tampered with in any way or if they contain or are the result of printing, digital, electronic, typographical, mechanical or other error. Without limiting the foregoing, an entry in the Sweepstakes will be automatically void if it is determined to be the product of an automated or mass entry attempt (that is, not manually key-stroked). Sponsor further reserves the right to condition receipt of Prize upon entrant furnishing Sponsor or its agency with satisfactory proof of using a legitimately obtained, valid Code to enter and/or that his/her potentially winning entry/play is otherwise in full compliance with these Official Rules. No more than the stated number of prizes will be awarded. In the event that production, seeding, printing, digital or programming failures, or other reasons or any errors cause more than the stated number of prizes to be available and/or claimed, Sponsor reserves the right to award only the indicated number of prize(s) (if previously not awarded), by a random drawing among all legitimate eligible claimants for prize(s). Sponsor’s sole liability for defective or erroneous Code is limited to replacement with another Code while supplies last. Sponsor reserves the right to terminate/cancel the Sweepstakes as a result of any printing errors. By playing this Sweepstakes, you agree to be bound by these Rules and the decisions of the judges. ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
DISPUTE RESOLUTION/CHOICE OF LAW: By participating, entrants agree that: (i) any claim, dispute or cause of action regarding the Sweepstakes or these Official Rules shall be brought individually (NOT AS PART OF A CLASS ACTION) in California State Court in Alameda County, California or in Federal Court in the U.S. District Court for the Northern District of California; (ii) they consent to the personal jurisdiction of such courts as the exclusive tribunal for adjudication of any such claim/dispute/cause of action; (iii) their recovery will be limited to actual out-of-pocket costs involved in participating in the Sweepstakes (if any) and they expressly waive their right to all other forms of recovery, including by way of example only, punitive, consequential, indirect, incidental, special and exemplary damages as well as attorneys’ fees for bringing such claim/dispute/cause of action; and (iv) the court shall apply the law of the State of California in adjudicating any such claim/dispute/cause of action, except for the choice of law/conflict of law rules of California (or of any other jurisdiction which would result in the application of the law of any jurisdiction other than California).
